General terms and conditions of sale:

When purchasing goods or services via this website the buyer undertakes to unconditionally accept the present terms and conditions of sale. These terms and conditions of sale prevail over all other general or specific terms and conditions not explicitly approved by VICTORIA ALBI SAS. VICTORIA ALBI SAS reserves the right to alter these terms and conditions of sale at any time. In that case, the terms and conditions of sale which are in force at the time the buyer places an order will prevail.

Characteristics of the proposed goods and services

The products and services offered are those published in the VICTORIA ALBI SAS website catalogue. These products and services are available while stocks last. Each product is accompanied by a manufacturer’s description. Whilst every effort has been made to select photographs which faithfully portray the products in our catalogue, variations, especially in relation to colour, may occur.

Prices

All prices in the catalogue are in Euro and are inclusive of all taxes. VICTORIA ALBI SAS reserves the right to alter prices at any time on the understanding that the buyer will be charged the price advertised in the catalogue on the date of ordering.

Orders

The buyer who wishes to purchase a product or service must:

– fill out the on-line order form by entering all the reference numbers of the chosen products or services;

– double-check and validate the order;

– submit payment in accordance with the applicable terms and conditions

– confirm the order and payment.

Confirmation of the order implies acceptance of the presentterms and conditions of sale, confirmation of being au fait with the terms and conditions and waiver to invoke one’s own terms and conditions of purchase or any other terms and conditions whatsoever. The data submitted together with the registered order will count as proof of transaction. The confirmation will count as a signature and as acceptance of the performed transactions The seller shall send confirmation of the registered order by e-mail.

Returns/Refund

The buyers, private physical persons, have a seven day period, from the date of delivery to return the product to the seller and to receive an exchange or refund, free of charge. Please note that goods are returned at your own expense.

Payment conditions

Goods are payable at the time of ordering. Payments must be made by bank card; all payments are performed via a secure system. The account of the buyer will not be debited until such time as the available products or services are dispatched and then only to the tune of the sent out or downloaded products and services.

Deliveries

Deliveries will be made to the address submitted on the order form which may not lie outside the agreed geographical area. All risks are borne by the buyer once the products leave the VICTORIA ALBI SAS premises. In the event of damage during transport, a reasoned complaint must be submitted to the carrier within three days from the date of delivery. Delivery terms are merely indicative.

Warranty

All the products supplied by the seller are covered by a legal warranty as provided for by article 1641 and following of the Civil Code. In the event of product non-conformity, the product may be returned to the seller who will take it back, exchange or refund it. Liability

With regard to online sales the seller is only bound by an obligation of means; he cannot be held responsible for any damage resulting from the use of the Internet such as loss of data, intrusion, viruses, service interruptions or any other inadvertent problems.

Rules of litigation

The present terms and conditions of sale are governed by French law. In the event of litigation, the competent courts of Paris have jurisdiction, notwithstanding multiparty defendants or introduction of third parties.
